Statutory rules and refund procedures for the Greek Climate Crisis Resilience Fee under Law 4389/2016 Art. 53 & Law 5162/2024.

Under Greek tax legislation (Law 4389/2016 Art. 53, as amended by Law 5162/2024 and AADE Circular A.1217/2023), the Climate Crisis Resilience Fee (TAKK) is legally imposed exclusively on the resident/guest who actually used the accommodation. If accommodation is not used, no statutory tax obligation arises. This policy explains how payments are collected directly by your host and how refunds are administered.

Cancellations Prior to Scheduled Stay

100% Refundable

If a guest cancels their reservation prior to stay and no accommodation use takes place, the prepaid statutory resilience fee is 100% refundable.

Full 100% refund of the prepaid TAKK resilience fee amount.
Tax rationale: Because no actual stay occurred, no tax liability arises toward the Independent Authority for Public Revenue (AADE).
Cancellation compensation or penalties charged by booking platforms are not accommodation services and are not subject to TAAK.
The host / accommodation operator is solely responsible for issuing the refund from their connected payment account.
Greek Law 4389/2016 (Art. 53) & Law 5162/2024: Fee applies strictly to actual nights stayed.
Pre-Arrival Cancellation (100% Refundable)

If a guest cancels their reservation prior to stay and no accommodation use takes place, the prepaid statutory resilience fee is 100% refundable.

Stay Use & Unused Nights

TAKK is legally tied to actual overnight stays. Nights consumed are statutory tax obligations, while unused nights due to early departure remain refundable.

Frequently Asked Questions

Do no-shows have to pay the Climate Resilience Fee (TAKK)?

No. Under Greek tax law (Law 4389/2016 Art. 53 & AADE A.1217/2023), TAKK is levied exclusively on the guest who actually used the accommodation. If a guest never checks in and never uses the property, no statutory duty is owed, even if a cancellation penalty is charged by the booking platform.

Who issues my refund?

Your accommodation host / property operator issues the refund. All guest card payments are routed directly to the host’s connected Stripe account. taakflow provides the software to calculate and track the fee, but does not hold your funds.

When is the monthly TAAK declaration submitted to AADE?

Hosts submit the monthly TAAK declaration to the Greek tax authorities (myAADE) by the last day of the month following the stay (την τελευταία ημέρα του επόμενου μήνα).
